By creating an account, subscribing to a plan, or otherwise using FORMIUS.AI (the "Service"), you agree to be bound by these Terms of Service (the "Terms") and our Privacy Policy. If you do not agree, do not use the Service.
FORMIUS.AI is a software-as-a-service form-building platform. The Service includes AI-assisted form generation, multilingual translation, response collection, file upload storage, team collaboration, and an HTTP API. Specific features and limits are described on our pricing page and in the user dashboard.
Paid plans renew automatically at the end of each billing period (monthly or annual). You authorize us, via Stripe, to charge your payment method on file. You may cancel anytime from the billing portal; cancellation stops future renewals but does not retroactively unwind a completed period.
Trials are offered at our discretion and may be revoked or modified at any time. Once a trial converts to a paid plan, the standard subscription terms apply.
We do not provide automatic refunds for partial periods, unused capacity, or failed AI generations. Failed generations consume your monthly generation quota. If you believe you were billed in error or experienced a service-side outage that materially affected your usage, contact support and we will review the dispute manually and at our discretion.
Each paid plan includes a monthly AI form generation quota. The quota resets every 30 days from the date of your first generation in the period. Successful and failed AI calls both count against the cap. Whitelisted operator accounts may have different limits at our discretion.
We reserve the right to modify subscription pricing, generation quotas, included features, and any other terms of the Service at any time, including in response to changes in our underlying AI infrastructure costs, usage patterns, regulatory requirements, or business strategy.
For material changes that affect existing paid subscribers (price increases or quota reductions), we will provide at least 30 days' advance notice via email and an in-product banner. Continued use of the Service after the change takes effect constitutes acceptance of the new terms. If you do not accept the change, your sole remedy is to cancel your subscription before the effective date; no refund is owed for the current paid-up period.
Non-material changes (clarifications, typo fixes, additions of features that do not reduce existing benefits) may take effect immediately upon publication.
You agree not to use the Service to (a) collect data unlawfully or without appropriate consent from respondents, (b) host or distribute illegal, infringing, or harmful content, (c) circumvent quotas or rate limits, (d) probe, scan, or test the security of the Service without prior written authorization, or (e) resell the Service to third parties without a written reseller agreement. We may suspend or terminate accounts that violate these rules.
You retain all rights to forms you create and responses you collect. You grant us a limited license to store, process, and transmit your content solely as necessary to operate the Service. We do not use your content to train AI models. See our Privacy Policy for details on data handling, retention, and deletion.
AI-generated form structures are produced by third-party large language models. We make no warranty that AI output is fit for a particular purpose, free of errors, or legally compliant for your use case. You are responsible for reviewing every AI-generated form before publishing it to respondents.
The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access, error-free operation, or that the Service will meet your specific requirements. To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the claim.
You may terminate your account at any time by canceling your subscription and requesting account deletion via support. We may suspend or terminate accounts that violate these Terms or for non-payment. After termination, your data is retained for 90 days and then permanently deleted unless legally required to retain it longer.
These Terms are governed by the laws of the Republic of Lithuania, without regard to conflict-of-law principles. Disputes will be resolved in the competent courts of Vilnius, Lithuania, unless mandatory consumer-protection laws of your country of residence provide otherwise.
